Andrew Olesnycky, One of Few Criminal Defense Attorneys Who Supervised Domestic Violence Cases in a Prosecutor’s Office, Joins Stahl Gasiorowski Criminal Defense Lawyers
Andrew Olesnycky Now Defends Criminal Clients in New Jersey and New York

Mountainside, NJ — September 2015 — One of very few criminal defense trial attorneys in private practice in New Jersey and New York who has held supervisory responsibility for the domestic violence unit of a county prosecutor’s office has joined the bi-state Robert G. Stahl Esq. Criminal Defense Lawyers, Mr. Stahl announced today.

After five years at the Union County Prosecutor’s Office, Andrew Olesnycky now concentrates his private practice at the Stahl law firm by defending individuals charged in state and municipal courts in the New Jersey and New York, representing men and women accused of domestic violence in criminal, civil, and administrative proceedings, as well as victims of domestic violence seeking restraining orders in family court.

Olesnycky was promoted to lead the Union County Prosecutor’s Office’s Domestic Violence Unit after previously serving in increasingly more prominent roles within the office. He joined the Stahl law office August of 2015.

During his Union County Prosecutor’s Office tenure Olesnycky tried numerous felony cases involving robbery, aggravated assault, gun possession, narcotics offenses, large-scale theft, and fraud.

“Andrew’s extensive experience as an assistant county prosecutor, especially in supervising all domestic violence cases, is a great asset for our criminal clients,” Stahl said. “Our office has defended men and women charged in Union County and I’m happy to see his legal skills now dedicated to Stahl Law clients who are being investigated or prosecuted in New Jersey or New York.”

“Domestic violence law is extremely complex. Having the benefit of counsel who not only knows the law but has seen it play out hundreds of times in real life can be invaluable to a client in these cases,” Stahl added.

Mr. Olesnycky’s extensive background in state criminal investigations and trials includes experience obtaining search warrants and communications data warrants (and defending their validity in court); compelling testimony of reluctant witnesses before a grand jury; obtaining extraditions from foreign jurisdictions; and presenting DNA testimony at trial.

As Domestic Violence Unit supervisor, Olesnycky was responsible for training new assistant prosecutors; supervising all investigations, indictments and trials within the Unit; coordinating rearming decisions for police officers accused of domestic violence; administering a 24-hour on-call domestic violence hotline for police officers; and training police officers in domestic violence law.

From arrest through trial, Olesnycky oversaw as supervisor a substantial prosecution caseload approaching 30 new criminal cases per month which included attempted murder, first-degree kidnapping, robbery, interference with custody, stalking, cyberharassment, and invasion of privacy. He also oversaw the prosecution of nonindictable restraining order violations and weapons forfeiture actions in the prosecutor’s office Family Division.

In addition to his supervisory responsibilities, Mr. Olesnycky continued to personally prosecute a significant docket of domestic violence cases that included attempted murders, aggravated assaults, kidnappings, and gun crimes.

Among the high-visibility cases Olesnycky handled was the nationally followed “revenge porn” case involving an NFL player who shared nude photos of his estranged girlfriend on the Internet. He also prosecuted an interference with custody case in which the defendant absconded to Europe with a developmentally disabled minor. He coordinated with federal authorities to secure the child’s return to the United States and obtained a guilty plea.

As a certified domestic violence law instructor at the John H. Stamler Police Academy, Mr. Olesnycky has lectured on domestic violence to new recruits as well as experienced investigators from law enforcement agencies throughout the state. He has served as a moderator of a statewide domestic violence symposium and attended domestic-violence specific training at state and national conferences.

Prior to supervising the Domestic Violence Unit, Olesnycky served in the Trial, PDC, Juvenile, and Appellate Units of the Union County Prosecutor’s Office. As a Trial Unit member, Mr. Olesnycky was the sole attorney representing the state in 11 jury trials and prosecuted hundreds more that were resolved by guilty pleas.

A cum laude graduate of the Rutgers School of Law in Newark, Mr. Olesnycky served as a law clerk to the Honorable Rudy B. Coleman (retired) in the Appellate Division of New Jersey Superior Court, and as an intern for the Honorable Joseph A. Greenaway in the United States District Court for the District of New Jersey. During law school, Mr. Olesnycky worked as a summer associate at Latham & Watkins LLP in Newark and as an intern in the legal department of the New Jersey Highlands Council.
